These Terms & Conditions (“T&C”) are legally binding under the laws of the State of Nevada. By accessing or using Aviotti Racing’s services, you acknowledge and agree to comply with these terms, as well as all applicable Nevada statutes, regulations, and rules. These T&C are subject to change at Aviotti Racing’s discretion, with updates effective upon publication. For specific legal guidance, consult an attorney licensed in Nevada.

TERMS & CONDITIONS - OVERVIEW

These T&C govern the relationship between Aviotti Racing and its customers, renters, and participants. They set forth the rights, responsibilities, and obligations associated with engaging in Aviotti Racing’s services, including but not limited to vehicle rentals, racing programs, and event participation.

By using Aviotti Racing’s services, you agree to these terms and all applicable Nevada laws. Aviotti Racing operates in compliance with the Nevada Revised Statutes (NRS) and other local regulations, including those governing contracts, liability, and consumer protections.

KEY PROVISIONS

  • Eligibility

    • To access Aviotti Racing’s services, you must meet eligibility requirements, including being at least 18 years of age, holding a valid driver’s license, and providing any additional documentation required under Nevada law.

  • Payment Terms

    • All payments must be made in accordance with the terms provided at booking. Refunds are subject to Aviotti Racing’s refund policy, which complies with Nevada consumer protection laws.

  • Modifications to Services

    • Aviotti Racing reserves the right to modify, reschedule, or cancel services due to unforeseen circumstances, including weather or operational constraints. Notification will be provided in accordance with Nevada’s business communication standards.

  • Liability and Risk Assumption

    • Participants acknowledge the inherent risks of racing and agree to release Aviotti Racing from liability for injuries, damages, or losses except in cases of proven negligence, in compliance with NRS Chapter 41, which governs liability waivers in Nevada.

  • Intellectual Property

    • All content, branding, and materials provided by Aviotti Racing are protected under Nevada and federal intellectual property laws. Unauthorized use, reproduction, or distribution is strictly prohibited.

  • Service Termination

    • Aviotti Racing may terminate services without notice for violations of these terms or unsafe conduct. Such termination will comply with Nevada contract and service termination laws.

  • Safety Compliance

    • All participants must adhere to Nevada safety regulations, including the use of proper equipment and following instructions from Aviotti Racing personnel. Failure to comply may result in immediate removal without refund.
       

NEVADA SPECIFIC LEGAL-DISCLOSURES

  • Aviotti Racing operates in compliance with Nevada’s contract laws, including NRS 104 (Uniform Commercial Code).
     

  • Any disputes arising from these T&C will be resolved in Nevada courts, with the applicable venue being the county where Aviotti Racing operates.
     

  • Aviotti Racing complies with the Nevada Deceptive Trade Practices Act (NRS Chapter 598) to ensure fair treatment of all clients.

AGREEMENT TO TERMS
